Retention of  Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Complaints/Withdrawal from the contract

  1. The Shop is obliged to provide the Customer with an item free from defects.
  2. It is recommended that the complaint should include, among others concise description of the defect, circumstances (including the date) of its occurrence, data of the Customer submitting the complaint, and the Customer’s request in connection with the defect in the goods.
  3. The Customer is obliged to attach to the complaint the proof of purchase of the goods subject.
  4. In the event of a defect in the goods purchased from the Shop, the Customer has the right to complain on the basis of warranty regulations in the Civil Code.

  6. Pursuant to the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827) the Customer who is a consumer has the right to withdraw from the contract in writing without giving any reason within fourteen days from the date of delivery of the goods, i. e., from the moment when the Customer came into possession of the goods or a third party indicated by the Customer, other than the carrier, came into possession of the goods. For the 14-day time limit referred to in paragraph 1 to be observed, it is sufficient to send a declaration of withdrawal before its expiry. 
  7. The right to withdraw from the contract is not vested in the Customer who has ordered an unprefabricated item, manufactured according to the Consumer’s specifications or used to satisfy his individual needs.
  8. In case of withdrawal from the contract, the customer is obliged to return the goods to the address: przyczolkowa 350, 02-962 Warsaw, Poland,  no later than 14 days from the date on which the Customer withdrew from the contract. Returned goods should be packed in such a way that they cannot be damaged during transport.
  9. In case the Customer exercises the right referred to in paragraph 6, the direct cost of returning the goods shall be borne by the Customer.
  10. In the event of withdrawal from the contract, the Customer shall be reimbursed all payments received from him/her, including the costs of delivering the goods to the Customer (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest usual method of delivery offered in the delivery of goods available in the Shop), immediately, and in any case no later than 14 days from the date of notification about the return or the date the Shop actually received the returned goods.
  11. Biossphere is obliged to immediately refund, not later than within 14 days from the date of reception of the Customer’s statement of rescission of the Contract, to the Customer all payments made by the Customer, including the charge for Delivery of the Item to the Customer. Biossphere may withhold the refund of payments received from the Customer until reception of the returned Item or proof, supplied by the Customer, of the Item having been sent, whichever occurs earlier.
  12. The refund is made by the Shop using the same method of payment as the Customer had used, unless the Customer expressly agrees to another method of refund that does not involve any costs to him/her.
  13. The Shop may withhold the refund until the receipt of the returned goods (items) or until the delivery of proof of sending back the goods in connection with the withdrawal, depending on which event occurs earlier.

Final provisions and amendments to Terms and Conditions

  1. The Terms and Conditions enter into force on the date of publication on the Online Store website, replacing the previously existing Online Store terms and conditions.
  2. The contents of these Terms and Conditions may be recorded by printing, copying to a storage device, or downloading at any time from the Online Store websites.
  3. In matters not regulated by these Terms and Conditions, the provisions of the Polish law shall apply, including in particular Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827) and the Civil Code.
  4. All orders accepted by the Store prior to the day of amendment to the Terms and Conditions shall be processed pursuant to the Terms and Conditions in force at the date of placing the order by the Customer.
  5. If at any time any provision of these Terms is or becomes illegal, void or invalid for any reason whatsoever, such invalidity shall not affect the validity of the remainder of these Terms and Conditions and such invalid provision shall be replaced by another provision which, being valid in all respects, shall have an effect as close as possible to that of the replaced provision.
